I met with a woman in Boerne, Texas recently whose father had passed away about a year earlier. She was amazed and frustrated with how long it took to have her father’s assets transferred to her and her siblings. She said all of the necessary court filings took much longer than anticipated. She wanted to make this process simple for her surviving heirs when she dies.

She told me she wanted to set up a trust so that when she dies, her brother (as the successor trustee) can have immediate access to all of her assets, sell her home if necessary, and distribute her assets to her heirs and beneficiaries. She did not want her brother to have to deal with frozen accounts and confusion over property titles.
