A lawyer can help Comfort residents prepare a living trust that reflects their wishes and property ownership. Properly funding the trust and transferring eligible assets into it can help simplify asset management and distribution after death.
Yes. A durable financial power of attorney allows someone you choose to handle certain financial and property matters if you become unable to manage them yourself. It can be an important part of an estate plan.
Review your estate plan after major life changes, such as marriage, divorce, a new child, property purchases, or changes in financial circumstances. Regular reviews help ensure your documents continue to reflect your wishes and current Texas laws.
Dying intestate (without a will) means Texas’s intestacy statutes determine who inherits — and the result is often not what the family expected. For example, a surviving spouse does not automatically inherit everything if there are children from a prior relationship. The estate must still go through probate, and the court will appoint an administrator rather than an executor of your choosing.
A will or living trust that names who receives the land, and how, prevents most disputes. If land is already in an estate, we confirm title and record the right documents so heirs can keep, lease, or sell it.
When someone dies without a will and the estate is worth $75,000 or less, not counting the homestead and exempt property, the heirs may be able to use a court-approved affidavit instead of full probate.
Yes. Most of the work can be done by phone, email, or video. We will let you know ahead of time if a signing or a Kendall County hearing needs you there in person.
No. As executor you are responsible for notifying creditors and paying valid debts from estate assets — but you are not personally liable for debts that exceed the estate’s value. There are important notice requirements and creditor claim deadlines under the Texas Estates Code that must be followed carefully to protect the estate and its beneficiaries.
