FAQs

Yes. A revocable living trust can hold eligible acreage and other property while allowing you to maintain control during your lifetime. It can also establish how the land will be managed and transferred to beneficiaries after your death when properly funded.

A properly prepared estate plan can establish clear ownership and inheritance instructions for rural property. Wills and trusts can help determine who receives the land, how it should be managed, and whether multiple heirs can share or transfer ownership.

Review your estate plan every few years and after major life changes, such as purchasing land, marriage, divorce, retirement, or changes in family circumstances. Regular reviews help ensure your documents and property ownership arrangements continue to reflect your intentions.

Dying intestate (without a will) means Texas’s intestacy statutes determine who inherits — and the result is often not what the family expected. For example, a surviving spouse does not automatically inherit everything if there are children from a prior relationship. The estate must still go through probate, and the court will appoint an administrator rather than an executor of your choosing.

A will or trust can say who gets which tract, or let one heir buy out the others. Without a plan, co-owners must agree on everything, and a dispute can end in a court-ordered sale.

When someone dies without a will and the estate is worth $75,000 or less, not counting the homestead and exempt property, the heirs may be able to use a court-approved affidavit instead of full probate.

It can, if the new owners keep the qualifying use and file what the appraisal district requires. If the use changes, the land may face a rollback tax. We help heirs plan around this before title passes.

No. As executor you are responsible for notifying creditors and paying valid debts from estate assets — but you are not personally liable for debts that exceed the estate’s value. There are important notice requirements and creditor claim deadlines under the Texas Estates Code that must be followed carefully to protect the estate and its beneficiaries.
