Yes. A revocable living trust can hold eligible farm or ranch property and establish how it will be managed and distributed to your children. Properly transferring the property into the trust can help avoid probate for those assets and provide clear instructions for future ownership.
Business succession planning can help establish who will manage or inherit a company if an owner retires, becomes incapacitated, or passes away. Buy-sell agreements, ownership transfer arrangements, and financial powers of attorney can help prepare the business for these situations.
Yes. You can review and update your living trust as your property and financial circumstances change. Newly purchased farmland should be properly transferred into the trust when appropriate so it is included in your overall estate planning strategy.
Dying intestate (without a will) means Texas’s intestacy statutes determine who inherits — and the result is often not what the family expected. For example, a surviving spouse does not automatically inherit everything if there are children from a prior relationship. The estate must still go through probate, and the court will appoint an administrator rather than an executor of your choosing.
Not always. Land held in a living trust, owned with survivorship rights, or covered by a Texas transfer on death deed can pass to family without probate. Land in the deceased person’s name alone usually needs a court process to clear title.
When someone dies without a will and the estate is worth $75,000 or less, not counting the homestead and exempt property, the heirs may be able to use a court-approved affidavit instead of full probate.
Yes. A durable power of attorney and a medical power of attorney let a trusted family member handle finances and health decisions if a parent can no longer act, which can help avoid a costly court guardianship.
No. As executor you are responsible for notifying creditors and paying valid debts from estate assets — but you are not personally liable for debts that exceed the estate’s value. There are important notice requirements and creditor claim deadlines under the Texas Estates Code that must be followed carefully to protect the estate and its beneficiaries.
