Yes. A special needs trust can provide financial support for a child with disabilities while helping preserve eligibility for certain government benefits, such as SSI and Medicaid. Proper planning can help protect your child’s financial future and provide resources for their ongoing care.
Business owners can use succession plans, buy-sell agreements, and ownership transfer arrangements to prepare for retirement, incapacity, or death. These legal documents help establish who will take over business operations and how ownership interests will be handled.
Yes. Moving to Cibolo is a good opportunity to review your existing will, trust, and powers of attorney. An attorney can evaluate whether your documents comply with Texas law and whether changes are needed to reflect your current property and family circumstances.
Dying intestate (without a will) means Texas’s intestacy statutes determine who inherits — and the result is often not what the family expected. For example, a surviving spouse does not automatically inherit everything if there are children from a prior relationship. The estate must still go through probate, and the court will appoint an administrator rather than an executor of your choosing.
A will or trust can let your spouse stay in the home while making sure your children inherit later. Without one, Texas law decides the split, and it may not match your wishes.
When someone dies without a will and the estate is worth $75,000 or less, not counting the homestead and exempt property, the heirs may be able to use a court-approved affidavit instead of full probate.
Often, yes. Texas allows a transfer on death deed, which passes the home to the people you name without probate. A living trust is another option. We help you choose the one that fits your family.
No. As executor you are responsible for notifying creditors and paying valid debts from estate assets — but you are not personally liable for debts that exceed the estate’s value. There are important notice requirements and creditor claim deadlines under the Texas Estates Code that must be followed carefully to protect the estate and its beneficiaries.
