FAQs

Yes. A revocable living trust may help you plan how your Hondo home, land, and other eligible assets will be managed and transferred. The property must be properly transferred into the trust for the plan to work as intended. An estate planning attorney can review your ownership and explain whether a trust fits your goals.

A special needs trust may help provide financial support for a loved one with a disability while preserving eligibility for certain means-tested benefits, such as SSI or Medicaid. The trust must be carefully structured and administered. An attorney can help determine which type of trust may be appropriate for your family’s circumstances.

Business owners may need a will, financial power of attorney, and a business succession plan. Depending on the company structure, buy-sell agreements and ownership transfer provisions may also be important. These documents can help establish who will manage the business if an owner becomes incapacitated or passes away.

Dying intestate (without a will) means Texas’s intestacy statutes determine who inherits — and the result is often not what the family expected. For example, a surviving spouse does not automatically inherit everything if there are children from a prior relationship. The estate must still go through probate, and the court will appoint an administrator rather than an executor of your choosing.

Generally, no. Debts are paid from the estate, not from heirs’ own pockets, unless someone co-signed. Texas also protects the homestead from most creditors when a spouse or minor child survives, so the family home is often safe.

When someone dies without a will and the estate is worth $75,000 or less, not counting the homestead and exempt property, the heirs may be able to use a court-approved affidavit instead of full probate.

After the court appoints you, you generally must publish notice to creditors within one month and file an inventory of the estate within 90 days. You also secure assets, open an estate bank account, and keep records of every payment.

No. As executor you are responsible for notifying creditors and paying valid debts from estate assets — but you are not personally liable for debts that exceed the estate’s value. There are important notice requirements and creditor claim deadlines under the Texas Estates Code that must be followed carefully to protect the estate and its beneficiaries.
