Yes. A lake house can generally be transferred into a revocable living trust if it is eligible and properly titled in the trust’s name. This can help establish who will manage the property and who will inherit it. An attorney can review the deed, ownership arrangements, and your estate planning goals.
Yes. If your lake property generates rental income, your estate plan can address how the property and its income should be managed or distributed. A trust may provide instructions for a successor trustee to manage trust-owned assets. An attorney can review the property’s ownership and your intended arrangements.
Yes. Purchasing a lake house can change your assets and inheritance plans. You should review your will, trust, and related documents to determine how the new property should be handled. If you already have a living trust, an attorney can help determine whether the property should be transferred into it.
Dying intestate (without a will) means Texas’s intestacy statutes determine who inherits — and the result is often not what the family expected. For example, a surviving spouse does not automatically inherit everything if there are children from a prior relationship. The estate must still go through probate, and the court will appoint an administrator rather than an executor of your choosing.
Yes. Texas lets you sign a written declaration naming who should, or should not, serve as your guardian if you ever need one. Along with powers of attorney, it keeps those decisions with people you trust.
When someone dies without a will and the estate is worth $75,000 or less, not counting the homestead and exempt property, the heirs may be able to use a court-approved affidavit instead of full probate.
Yes. In Texas, owning property jointly does not automatically give the survivor full ownership. Without a written right of survivorship or a will, part of the home may pass to children instead of the surviving spouse.
No. As executor you are responsible for notifying creditors and paying valid debts from estate assets — but you are not personally liable for debts that exceed the estate’s value. There are important notice requirements and creditor claim deadlines under the Texas Estates Code that must be followed carefully to protect the estate and its beneficiaries.
